Abstract The question of the time frame of a pre-trial investigation was considered in the works of many scientists, however, new changes to the Criminal Procedure Code of Ukraine (CPC Ukraine) regarding the time frame of a pre-trial investigation again determine the relevance of this issue. Of particular concern there are questions arising in the process of implementing the new provisions of the Criminal Procedure Code of Ukraine regarding the time frame of a pre-trial investigation.
The purpose of the article is to analyze the current regulatory framework for the terms of a pre-trial investigation, to clarify problems related to its implementation, to identify and assess the shortcomings of the regulatory framework for the time frame of a pre-trial investigation.
Also in the article it is noted that the new rules do not fully correspond with the determination of the time of expiration of a reasonable period in the practice of the European Court of Human Rights. The following is indicated: the continuation by the investigative judge of the terms of a pre-trial investigation will require them to evaluate the effectiveness of the pre-trial investigation, which traditionally belonged to the powers of the prosecutor. The shortcomings of the normative formulations regarding the subjects of initiation of the extension of the period of a pre-trial investigation are identified.
The conclusion is made about the destructive effect of the new rules regarding the timeframe of a pre-trial investigation in defense of the rights of victims of criminal offenses and on the effectiveness of a pre-trial investigation in general. Such a regulation will not be able to achieve a reasonable balance of public and private interests in criminal proceedings.
The author suggests that a pre-trial investigation should not be limited to deadlines, and the issue of the movement of criminal proceedings in which no one was informed of suspicion should be solved using a procedural mechanism that would not question the possibility of protecting individuals, society, and the state from criminal offenses.
